At Toned Pilates studio, we are committed to protecting your privacy as an online visitor to our website. We use the information we collect about you to maximize our services. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles. Please read our privacy policy below carefully.

You may change your details at any time by advising us in writing via email. Our secure server protects all information we receive from our customers. Secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorized use or access. We do not store credit card information on our servers.

Storage and Security of Your Information

We receive and store the information you enter on our website or give us in any other way from time to time. You may provide basic contact information such as your name, phone number, address, and email address to enable us to send information or process your product order; we may also collect additional information at other times, including but not limited to when you provide feedback, change your content or email preferences, respond to a survey, or communicate with our customer support.

We may use personal information collected from you to provide you with direct marketing material, updates regarding our website, and information in the form of a newsletter. This will only apply if you have registered or subscribed to such publications by registering your details with us.
If you wish to cease receiving any such information, you may let us know either by email or unsubscribing, and your request will be actioned immediately.

Individual profile and company details are not used for any other purpose. Details are only supplied to a third-party supplier when required by law for goods or services you have purchased or protect our copyright, trademarks, and other legal rights.

We respect the privacy of our online visitors. We may collect information on or through this website to identify you personally. For example, we collect personally identifiable information, which you volunteer us to respond to visitor questions and comments about us and our products and services, and mail e-newsletters (“Personal Data”).

We will use all reasonable means to protect the confidentiality of your Personal Data while in our possession or control. We will not knowingly share any of your Personal Data with any third party other than our service providers, who assist us in providing you with the information and services we are providing. To the extent that we do share your personal information with a service provider, we would only do so if that party has agreed to comply with our privacy standards as described in this privacy policy. Some of our service providers may be overseas and may not be subject to Australian Privacy Laws. Please get in touch with us if you require specific details.

Any non-personal information, communications, and material you send to this website or us by email, or which we obtain from third parties without promises of confidentiality, may be kept, used, and disclosed by us on a non-confidential basis. We are free to use and reproduce any such information freely and for any purpose whatsoever. Specifically, we will be free to use any ideas, concepts, know-how, or techniques contained in such information for any purpose, including developing, manufacturing, or marketing products.

Toned Pilates Terms and Conditions 

TONED PILATES STUDIO TERMS AND CONDITIONS

By signing up to participate in our classes, you agree to be bound by our Terms and Conditions set out below (Terms and Conditions).  

If you do not agree with any of these Terms and Conditions, please do not participate in our classes.  

We reserve the right to change, update or reissue these Terms and Conditions at any time.  Any such changes will be posted to our Website and you agree to be bound by such changes.  

References to “we”, “us” and/or “our” in these Terms and conditions is a reference to Toned Pilates Studio Pty Ltd.

 

 Medical Warning

Prior to undertaking any new form of exercise, you should consult with your doctor or other healthcare practitioner to ensure that you are mindful of your current health and any restrictions that may be appropriate for you.  

When participating in our classes, do not over exert yourself and work at your own pace. Stop immediately if you feel pain or discomfort.  You should immediately seek medical attention if there are any unanticipated changes to your physical condition at any time.  

You must notify your instructor if you have any pre-existing injuries or medical conditions which may impact upon your ability to perform the exercises in our classes.  

By undertaking any exercise program (including the use of any equipment purchased from us), you acknowledge that you do so at your own risk that the instructors of our exercise programs will not be liable for any personal injury, loss or liability of whatsoever nature arising as a result of, or in connection with, your undertaking of any such exercise program or following advice contained on our website or given by our instructors.  

 Cancellation Policy 

To cancel a booking, you must notify Toned Pilates Studio at least 2 hours prior to the commencement of the class. Cancellations made with less than 2 hours' notice will incur the late cancellation cost of the class booked.   Late cancel fees are $5 per late cancel and $10 for a No show 

Class bookings can be cancelled online by logging into your account and choosing to unreserve the class you wish to cancel, or by calling or emailing your Studio.  

If you know you will not be able to make a class for which you have booked, within the 2 hour cancellation window, we strongly encourage a cancellation to be made, so that another person may take your reservation on the reformer.  

Cancellation of your membership requires a notice in writing of 28 days

Overdue Fees & Revocation of Membership Entitlements
All entitlements and entry into Toned Pilates is revoked if a member’s account is in arrears.
If your automatic direct debit reverses or is returned to us by your financial institution the following process will apply:
If the debit remains outstanding it will be processed within 3 days of the reversal with any reversal and late fees that apply.
If you fail to pay us the fees by the due date, we are entitled to refuse you entry to the Studio.
If unpaid fees remain outstanding and after attempts by us to rectify the arrears, your membership may be forwarded to a collection agency for further action.

Cancellation / Termination
A cancellation request should be provided to your Studio as follows:
During Cooling Off Period:
Your membership is subject to a 48 hour cooling off period.
The cooling off period applies to new memberships only and does not apply to membership renewals, upgrades or downgrades.
The cooling off period starts from the date the agreement is entered into (the date the agreement is signed) and ends at the close of business 48 hours later.
Your membership can be cancelled during the cooling off period by contacting your home studio via the studio contact details as listed on the website.

All monies paid will not be refunded. Toned Pilates may require an additional payment to recover costs in relation to any fitness services provided to the member within this period.

Permanent Sickness or Physical Incapacity:
Toned Pilates requires a medical certificate stating that you cannot utilise any fitness services or facilities because of your permanent illness or physical incapacity.
Toned Pilates may agree to cancel the membership upon payment of a cancellation fee of 10% of the minimum membership fee or $75.00 (whichever is less).
Cancellation for any other reason (within minimum term):
You may terminate your membership agreement before the expiry of the minimum term (or payment amount) if all instalments and fees due up to the date of termination are paid and the relevant cancellation fee is paid in full at the time of cancellation request.
The cancellation fee, is the total amount of your remaining minimum cost.
Cancellation due to relocation (within minimum term):
You may terminate your membership agreement before the expiry of the minimum term (or payment amount) due to relocation, you must have relocated more than 25km from the nearest Toned Pilates Studio, Proof of relocation must be provided to Toned Pilates with a cancellation fee of $250.00. Toned Pilates has the right to deny cancellation due to relocation If proof of relocation does not meet the Toned Pilates Studio requirements.
Cancellations after completion of Minimum Term:
Toned requires you to contact your home Studio via the Studio contact details as listed on the website advising of your cancellation request.
There will be a period of notice of 28 days, unless otherwise specified, from the date of cancellation request to the date of termination, during which any payments that fall due must be paid in full.
The notice period will exclude suspension or payment break time applied to your membership.
Any instalments/fees due at the date of termination (including instalments/fees which fall due during the notice period) will remain a debt owed to and recoverable by Toned Pilates Studio
You shall not consider that your membership agreement has been terminated until such time as this is confirmed in writing to you by Toned Pilates. Termination of your membership agreement will also terminate the Direct Debit Request Authority.
Cancellation of paid in advance memberships (PIA):
If you have paid for a 6 or 12-month membership in advance and need to cancel the membership, you may be able to cancel the membership and receive a pro rated refund. The following needs to be met:
Permanent illness or incapacity: You must provide a medical certificate from a certified medical practitioner stating that you are permanently ill or incapacitated preventing you from using the Facilities and services for the remainder of the Term your membership plan. Toned Pilates will terminate your membership and deduct the cancellation fee of $75.00 from the pro rated amount.
Relocation: If you are relocating to an address outside of 25km from the nearest Toned Studio, you may terminate the Agreement by providing the cancellation fee of $250.00 You must provide two items of written evidence of your relocation, e.g. driver’s licence with updated address, letter from employer, or evidence of lease agreement and electricity contract.
Suspension:
Suspension of payments may be possible under the terms of your Membership Agreement. Payments may be suspended for a minimum of 2 weeks at a time so long as the total time suspended within 12 months does not exceed 8 weeks. In order to suspend payments, you must contact admin@tonedpilates.com.au with suspension details at least 3 days prior to the date of the first suspended payment, Suspensions will start from your next Direct Debit date at $5.00 per Week. Suspensions will not be backdated and any time spent on suspension will be added onto the minimum term of the Membership Agreement so that the sum of the instalments payable for the minimum term or number of payments shall still be payable regardless of any suspension or suspension charges made

 Class Waitlists

No availability in a class? No problem! If you are unable to book a spot because the class is full, register yourself on the waitlist and when a spot becomes available, you will be notified via email and Text message, you will be automatically booked into the workout. Please ensure you check your email for your waitlist confirmation.

As a courtesy, if you are no longer available to attend the class, please remove yourself from the waitlist online or via the smart phone app. Once you have been confirmed in the class from the wait list, our 2 hour courtesy policy applies and a cancellation fee will apply if cancelled within this time.

Conditions of Entry

Toned Pilates Studio, reserves the right to refuse entry to, or eject from any of our Studios, clients or others who are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of our clients or other people at the Studios.

In order to minimise disruption during classes held at our Studios, we recommend that you aim to arrive at least 5 minutes prior to the scheduled commencement time of a Class. Once the class has started, your reformer may be given to someone on the waitlist.

Clients are strongly discouraged from departing classes prior to their scheduled conclusion time as it is disruptive to the enjoyment of other students attending those classes

Smoking is prohibited inside and out the front of our Studios at all times.

You are required to treat all persons and property at Toned Pilates Studio with all due care and respect.

Students are required to wear appropriate attire for physical exercise at all times while visiting our Studios and must refrain from wearing clothing that may present a danger to themselves.

For hygiene purposes, socks must be worn at all times during your workout. Specialised Pilates grip are available to purchase in the studio.

For the enjoyment of all participants in your class, please turn your phones to silent before your workout unless you are a doctor and you are on call, for example.

Personal Safety and Acceptance of Risk

By attending our Studio and participating Pilates classes, you will be performing physical activity and exercise which has an inherent risk of personal injury. Participating in Pilates is undertaken at your own risk.

You must inform instructors if there are any risks to your health by participating in Pilates, including in a Class, such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, prior to commencement. Participating in any form of exercise at our Studios with a Medical Condition is done entirely at your own risk.

You acknowledge that your participation in any from or exercise at our Studio may involve risks, including risk of personal injury.  

Toned Pilates instructors and studio staff are not medically trained and are therefore not qualified to assess whether clients are in good physical condition and/or that clients can engage in exercise without detriment to their health, safety, comfort or physical condition. Clients are advised to seek medical advice prior to commencing any exercise program if they are in any doubt about their ability to engage in exercise.

By participating in our classes, you agree that our liability in relation to recreational services (as that term is defined in section 139A of the Competition and Consumer Act 2010 (Cth)) for any death, physical or mental injury (including aggravation, acceleration or recurrence of any such injury), the contraction, aggravation or acceleration of a disease, the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that is or may be harmful or disadvantageous to you or the community, or that may result in harm or disadvantage to you or the community, that may be suffered by you as a result of the supply of recreational services by Toned Pilates Studio is hereby excluded, save that this limitation of liability does not apply to significant personal injury suffered by you as a result of reckless conduct by Toned Pilates in supplying the recreational services.
